Immigration Evaluations
There are several instances in which a psychological evaluation can be a powerful piece of evidence to help support you with the case before the United States Citizenship and Immigration Services (USCIS). Such cases include but are not limited to:
* Extreme and exceptional hardship
* Political asylum
* Spousal abuse(VAWA)
Extreme hardship:
A citizen or resident of the United States may apply for an immigration waiver, if the deportation of a relative causes hardship. A psychological evaluation documents the hardship, and all relevant factors are examined and identified. Examples may include health diagnoses, medical disabilities, impaired work and social functioning and financial difficulties. The accurate assessment and communication of these conditions can play a critical role in cancellation and removal as well as possible approval for political asylum. Each assessment is unique, with no particular result in mind. Professional judgement based on the data are what is used to complete the final written report. Reports are comprehensive,and carefully organized to provide if any, all potential hardship factors. All legal questions are
to be directed to your attorney.
Political asylum:
The purpose of an assessment for political asylum is to collect information about mistreatment of a noncitizen in their home country such as extreme deprivation, torture and psychological distress. Often times, the mistreatment is associated with political, ethnic,religious, gender or other human rights factors. The assessment examines the psychological impact of these circumstances, and documents the presence, if any, psychosocial stressors that may have prevented a person from filing for political asylum within one year, as required by law. All legal questions are to be directed to your attorney
Spousal abuse waiver:
Psychological evaluations are performed on individuals who suffer from verbal, physical, sexual, or psychological abuse. The spousal case involves a male or female from a foreign country who marries a citizen or legal permanent resident of the United States. The abuse ensues after they have been legally married. The
psychological evaluation documents if any, the nature, severity, and frequency of the abuse. The evaluation also documents the consequences of the abuse, which may include however not be limited to such diagnoses as Anxiety,Depression, and Posttraumatic Stress Disorder. All legal questions are to be directed to your attorney.
